BWS Collection Statement

Who we are and what is the purpose of this Collection Statement?

The purpose of this Collection Notice is to explain how Endeavour Group Limited ABN 77 159 767 843 trading as BWS – Beer Wine Spirits (BWS, “we”, “us” or “our”) collects, uses, stores and discloses the personal information of customers with registered accounts (“Registered Account Customers”, “you” or “your”) and other BWS customers, gift recipients, pick-up nominees and/or delivery recipients (“Guest Customers”, “you” or “your”). Personal information that we collect from you includes your name, address, email address, mobile number, date of birth, ID type, vehicle plate number (if required), and payment details.

Everyday Rewards Members

If you are a member of the Everyday Rewards program and you either scan your Everyday Rewards card in-store at BWS or link your Everyday Rewards membership to your BWS account online, personal information will be collected by the Everyday Rewards program. Who do we collect personal information from?

BWS collects personal information from Registered Account Customers and Guest Customers. Personal information collected from Registered Account Customers and Guest Customers includes your name, address, email address, date of birth, ID type and payment details.

What are the purposes of collecting your personal information?

General

The purpose of collecting personal information from Registered Account Customers and Guest Account Customers is:

  • to provide you with products, services and customer support
  • to set up, manage and secure your account
  • for multi-factor authentication when accessing your BWS account online by verifying your identity
  • to process orders where you are the recipient
  • to perform administrative functions;
  • to verify your identity and to detect fraud activities. We may conduct auditing and monitoring of transactions and financial engagement;
  • to communicate with you about products, services and promotions;
  • to seek customer feedback from you (including via surveys and product reviews) and to publish feedback provided;
  • for business improvement purposes;
  • to keep our records accurate and up-to-date;
  • to respond to your enquiries and complaints; and
  • to comply with our legal requirements and obligations that may relate to our licences, including reporting to regulators and law enforcement.
Registered Account Customers specific purposes

BWS collects further personal information from Registered Account Customers for marketing, promotion, research and analytical purposes, including targeted offers and promotions from BWS and our third-party partners. For further information on your rights to opt in or opt out of marketing communications, please read clause 22 of the BWS Terms and Conditions.

BWS anonymises or aggregates the personal information that we collect for the purpose of carrying out customer analytics. This helps us to understand our Registered Account Customers' preferences, interests, shopping patterns and behaviours so that we can improve and better administer BWS offers and promotions, and more effectively personalise the experience of our customers in promoting our goods and services.

When does BWS collect personal information?

General

BWS generally collects personal information from Registered Account Customers and Guest Customers when they shop with BWS in-store and online, or use BWS live chat on the website. This includes information about your transaction and browsing history (such as items purchased, the price of those items, the date of purchase, and the location of the store).

Collection upon delivery

When you place an online order on our website, our third party delivery driver may collect, on our behalf, personal information taken from the delivery recipient’s valid ID. The information collected will depend on the relevant third party delivery partner and the state and/or territory your order is being delivered to. For example, this may be collected by scanning the recipient’s ID or entering the information into the driver's mobile application and may include information contained on the recipient's ID, such as first and last name, date of birth, and the ID type.

Collection of such personal information is to ensure our and the third party delivery partner’s compliance with alcohol sales regulations. If the delivery recipient does not provide such information, we will be unable to complete the delivery. This information will be deleted or de-identified once no longer necessary or required to be retained by law.

Registered Account Customers specific collection

BWS also collects personal information from Registered Account Customers in the following circumstances:

  • When registering for or administering a Registered Account and whether you have taken up any BWS promotions or offers. This may include any previous transactions and browsing history prior to joining as a Registered Account Customer.
  • When the Registered Account Customer makes a purchase online at bws.com.au or through the BWS app while signed into their Registered Account.
Please note that BWS systems render payment card numbers, Apple Wallet and Google Pay details unreadable (through the use of cryptographic hashing or encryption algorithm) and replace them with a token number, which protects such details from unauthorised access or disclosure. Linking this token number with your account enables us to collect your transaction histories even when you use your Registered Account online (or do not scan your Everyday Rewards card in store). In a similar way, we also collect your transaction history from purchases made at our related businesses using the payment card, Apple Wallet or Google Pay associated with your Registered Account. This means that, for example, if you buy products at a Woolworths supermarket, we can link this information to you as a BWS customer. This includes your transaction history prior to the date of this Collection Notice. Collecting this information enables BWS to continue to provide Registered Account Customers with personalised and more engaging and relevant offers and promotions than they would otherwise receive.

Does BWS collect personal information from others?

BWS collects personal information about Registered Account Customers from other persons or entities, including our related businesses (such as Woolworths, Dan Murphy’s, Cellarmasters, ALH and Langton’s). For example:

  • BWS collects personal information for marketing purposes from other suppliers of goods or services who have an existing relationship with Registered Account Customers. Such entities include our strategic partners (including the Everyday Rewards program), and suppliers of publicly available information and digital services used by Registered Account Customers (including social media platforms); and
  • When Registered Account Customers make a purchase from a related business using a payment card associated with your Registered Account, BWS collects personal information including your transaction history at those related businesses.

For purposes other than marketing, we collect personal information from persons and entities that assist or partner with us in supplying our goods and services to Registered Account Customers, administering and improving BWS online and conducting our business generally. These entities include insurers, providers of publicly available sources of information, delivery service companies, possible business sellers and buyers, third party data providers and our related bodies corporate (as defined in the Corporations Act 2001 (Cth)).

At times, we combine different sets of data to add to the personal information we hold. An example of this is a history of a customer's transactions from use of the same payment card for purchases at BWS and our related businesses.

Does BWS collect personal information under a law or order?

BWS does collect personal information of Registered Account Customers and Guest Customers under various laws. These include taxation laws, corporations law (for example relating to our shareholders), anti-money laundering laws and privacy laws. We may also collect personal information about Registered Account Customers if we are required or authorised to do so by a court/tribunal order.

Can you provide the personal information of others?

In limited circumstances you may provide BWS with someone else’s personal information.

This will include:

  • when you purchase a gift or gift card for others
  • when you nominate someone to pick up your order (as a pickup nominee)
  • when you place an order on behalf of someone else
Before you provide another person’s personal information you should have:
  • Obtained consent from nominees for their information collection and we may ask you to provide evidence of that consent. You should not provide someone else’s information if you don’t have their consent.
  • Informed that you are providing their information to BWS and why; and
  • Let them know of this Collection Statement and BWS Privacy Policy.
  • You should not provide another person’s personal information for malicious purposes.

What happens if BWS is unable to collect your personal information?

If you do not provide us with the required personal information, it may be impossible to become a Registered Account Customer or to purchase products or services from BWS.

If Registered Account Customers do not permit us to collect the personal information needed by us (such as their email address) we may not be able to provide you with personalised BWS offers. For further information, please read the BWS Terms and Conditions.

How does BWS disclose personal information of Registered Account Customers and/or Guest Customers?

Disclosure to others

We disclose the personal information we collect about Registered Account Customers and Guest Customers to other persons and entities.

For example, we disclose personal information to:

  • our service providers (including to our information technology and marketing service providers) and our third-party marketing partners to assist us in carrying out our functions and activities;
  • our service providers who use the personal information to detect or prevent fraud for BWS, and who may use (but will not disclose) the personal information in order to provide fraud detection and prevention services to others;
  • entities affiliated with BWS, which assist and support us in bringing you BWS offers and promotions;
  • to our related businesses; or
  • to regulators or courts for compliance with the law or otherwise as legally appropriate.
Overseas recipients

We are likely to disclose personal information about Registered Account Customers to overseas recipients. Our Privacy Policy provides information about the countries in which such recipients are likely to be located.

Can BWS change its Collection Notice?

We may change the terms of our Collection Notices from time to time. A copy of the revised Collection Notices will be available on the bws.com.au or can be obtained by calling the Customer Contact Centre.
